Most of the personal information we process is provided to us directly by you for one of the following reasons:

  • Preparation of confidential reports and agreements.
  • Assessment of financial status for legal aid claims.
  • Submission of claims for the Family Voucher Scheme.
  • Contact of partners or ex-partners to invite them to take part in mediation.

4. Why We Collect The Personal Data 

We use the information that you have given us in in the process of providing mediation services.

We may share this information with:

  • The Family Mediation Council (family voucher scheme).
  • The Legal Aid Agency (Legal Aid Claims).
  • The Police (serious crime reporting/safeguarding)
  • Social services safeguarding of an adult or child).

Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:

(b) We have a contractual obligation.

(c) We have a legal obligation.

(d) We have a vital interest.

(e) We need it to perform a public task.

5. How We Store Your Personal Information

Your information is securely stored.

We keep information for the following time periods:

  • General Information – one year.
  • Billing and Invoicing Information – six years.
  • Legal Aid files – six years.

We will then dispose your information by deleting electronic records or shredding paper records.

6. Your Data Protection Rights

Under data protection law, you have rights including:

Your right of access – You have the right to ask us for copies of your personal information.

Your right to rectification – You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.

Your right to restriction of processing – You have the right to ask us to restrict the processing of your personal information in certain circumstances.

Your right to object to processing – You have the the right to object to the processing of your personal information in certain circumstances.

Your right to data portability – You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

7. Deletion of Personal Data

Please contact us at Dave Warren at dave.warren@arcresolution.co.uk or Suite 11, Cavendish House, Hoddesdon EN11 0LB, if you wish to have your personal data deleted.  We will delete data held on you within one month of you contacting us, unless we are required to retain your data under the laws of England & Wales.  We will confirm to you that your data has been deleted or the reason why it has been retained.

  8. Opting Out of Data Use for Marketing and Advertising

You have the right to opt out of personal data collection, for advertising or marketing purposes.  Contact Dave Warren at dave.warren@arcresolution.co.uk or Suite 11, Cavendish House, Hoddesdon EN11 0LB with your request to opt out of personal data storage, identifying the specific area of marketing you wish to opt out of,  and we will erase data held for marketing or advertising purposes within one month of you contacting us.  We will confirm to you that your data has been erased.
