There are two ways to find help with the cost of family mediation – Legal Aid and the Family Voucher Scheme. In this first post, we’ll look at Legal Aid.

Part 1: Legal Aid

Here’s three simple questions you need to ask, to judge if you might be eligible:

  1. What Are The Issues I’m Facing?

Problems like deciding on the split of assets and liabilities and how much time the children will spend with each parent, can be decided by a court, and are covered by Legal Aid.  Other disputes, like communication difficulties between parents, are not covered by Legal Aid (but can be mediated).

  1. What’s My Income?

If you receive certain benefits (e.g. Universal Credit) your income is not assessed.  If not, your monthly income must not exceed £2,657 (without deductions) and your net income (with allowable deductions) must not be above £733.

  1. What Valuable Things Do I Own?

You must have less than £8,000 of investments, property or other valuable items (known as capital).  There are allowable reductions in assessing the value of some forms of capital (e.g. mortgages).
